Ok, Long story, hope someone can help me out.
July 31, 2007, I was stopped at a light and a girl hit me from behind going 30mph, her insurance company is Allstate. After me going to the hospital, my husband took me, and coming home the next day, i had issues with her insurance comp. They made me make a statement about the wreck, told me it was their fault and gave me an estimate of my car’s worth. The damage was more than my car was worth, so they gave me a quote of 3400 for my car. Too bad I still owe on my car as well. The check went to Car Max. They asked me to “release” the car to them, and wanted me to tell the garage (where it was being held), to release the vehicle to them. When I hesitated, they started yelling at me on the phone, so i decided to release the car to them, for fear of being in trouble. After that, I didn’t want to deal with them anymore, and decided to goto a lawyer. I decided on this lawyer, and they sent out a man from their firm to go over everything with me. I gave him my accident report (the original), and he said they would make a copy and give the original back, which has not been done. I agreed to 33.3% of my settlement to their firm. I signed the paper, and never heard from him again. I called the law office, and was wondering what was going on. They told me my case had been assigned to this one lawyer lady. I talked with her a few time, since I was still in therapy, going to the chiropractor, my case was still open and had to wait until i was done with my therapy. October 2007, i finished therapy and told the lawyer i was done, but she never returned my calls. I, after weeks of calling, found out from the secretary, was assigned to another lawyer lady because the first one wasn’t doing her job and got fired. I tell the second lawyer lady that I am ready to end this, and to get all my amounts together, i still owed money to the hospital, chiropractor, and i missed work as well. She told me that she didn’t have any of that info. So, I had to get all of that for them. I had to goto the hospital, pick up my x-rays, get my manager of my job to fill out a missed work packet, and still they don’t return any of my phone calls. I wait for a couple of weeks, and find out i’m pregnant, so i really need them to get me my money! I finally talk to the second lawyer lady and she tells me her supervisor is taking over for her on my case because it’s being finalized. I talk with her supervisor a couple of times and then I get a letter in the mail stating what im asking for from Allstate. I am a month away from giving birth, and call the supervisor, ask her when im gonna get my money. She told me to just wait. I give birth in june 2008, and call her again, she says wait. January 2009, she calls me to tell me that in two days, Allstate is going to call me three way with her and i need to give a statement again, they will be asking me questions, so to have all my receipts and things out so i can reference to them. Since then, i have not heard from the supervisor, i keep calling and she never calls me back. I have faxed the time missed packet to her several times, and the last time i talked with her, she said she didn’t get it. I have faxed it twice since i’ve talked with her and gave the statement, but she never calls back. What can i do at this point? it’s almost two years since the accident. do i have statute of limitations on this? Can i just dismiss this lawyer and go with another law office and sue this office? Please, if any lawyers can help?
Oh, yeah, for the past two weeks, i have been calling the law office every day, and leaving messages everyday, and today she is in a meeting and i had to leave another message. I even say that “I have been trying to get a hold of her, but she never returns my calls.”
Thankyou for the two answers i have gotten so far, i just called the law firm and asked to take a message again. Should I demand my entire file from the secretary if i can not get in touch with the lawyer herself?
