I was in an accident last April (so just about a year ago now). Basically, a SUV cut accross 2 lanes of traffic and crashed into my car (saturn). I have a witness, an off duty cop saying that it was not my fault and my insurance company found me %100% NOT at fault and waived my deductable and everything.
Just the other day I recieved papers stating that I was going to be sued for $30,000 by the driver of the other car. I believe they are claiming injuries that were caused by my reckless driving?!
No one was brought to hospital from the accident and it wasnt very high impact at all so I really do not think anyone was really injured (he had a passenger). There was obviously damage to both our cars, mine was worse.
I’m pretty angry at this point. I’m wondering if I have a case against the other driver? It makes me so mad that someone would cause an accident then sue the person they hit pretty much blaming them (me) for the accident/injuries.
What does everyone think?
I actually have contacted my insurance company’s lawyer, he was actually on top of this and foresaw a possible suit coming after he had already sent a statement to the guy who hit me attorney saying that he believed I was not at fault in the accident. My lawyer said that they would have 3 years from the day of the accident to file a suit against me and pretty much 1 week after my lawyer told me that , I was served with papers from the sheriff’s office.
So are we saying there pretty much aren’t any grounds for a counter suit?
