So, I was driving home, when a girl came speeding around the corner in my apartment complex on the wrong side of the road. Long story short, it got ruled 100% her fault. Now I ended up doing 6 months of chiropractic visits and 2 months of physical therapy. I don’t feel different and I am going to have permanant back and neck damage (not severe just not comfortable to be on my feet a long time, sleep, or do strenuous activities, I’m a Chef). That’s not it. My wife was about 37-38 weeks pregnant, and we went to a doctors visit a couple hours after the accident. She wasn’t in the car, but freaked out when she heard the accident and came out of the apartment and saw it was me. The doctor diagnosed her with preeclamsia (high stress during pregnancy) because of the accident and had to induce her that night. The drugs slowed the baby’s heart rate, so they had to give a c-section. They only offered $3k to start and they say my wife doesn’t matter because she wasn’t in the car. suggestions?
So to answer a few questions.
First of all both the cars were totaled. I have soft tissue damage, and my back seems to mis-align easily. I had not had any health problems prior at all. I only went to the chiropractor that long because my insurance said to just see if it helps, even though I told them 2 months into it that it hadn’t helped. I had visits 3 times a week. An IME was done, and they said to go to 10 visits of PT and if that didn’t help they may have to rule it as a permanant injury. Though, to get proof, what should I do? It was ruled 100% her fault so it doesn’t really matter with my policy. The medical bills were probably about $5000 total. I most likely can get a letter from my wife’s OB which was also the on-call doctor, saying it was related with the accident. When we went in that day, thats when she was diagnosed, the OB actually asked what the hell happened that day. Do you think that would do the trick? Several days ago, I was a passenger in car accident. We had the right of way at traffic light (green light), crossing the intersection and going straight and someone from Left Hand Side Ran Red Light and Hit Us. I went to the hospital for Back Pain, Knee Pain, Chest Pains and diagnosed as Severe Contusions. Does this also count towards Bodily Injury? What claim can I make, If any?
Several days ago, I was a passenger in car accident. We had the right of way at traffic light (green light), crossing the intersection and going straight and someone from Left Hand Side Ran Red Light and Hit Us. The Police Report has been also obtained and other driver has been found at fault. The situation is complicated, as other driver had Unexpired Tags, Unexpired Insurance, Unexpired Registration. I went to the hospital for Back Pain, Knee Pain, Chest Pains and diagnosed as Severe Contusions (Crushing of Tissue in Knee and Chest). Does this also count towards Bodily Injury? What claim can I make, If any?
In terms of the Vehicle, The Front of Vehicle was totally engulfed in Flame, as Engine Blew Up. Also, the Front of car is totally smashed in.
In terms of the Accident, It occured in State of New Jersey. I have my own Drivers License, Car and Insurance through State of Delaware, as I have legal residence there. Why not go to lawyer?

Auto accident, injury claims question hit/run UMC?

I was involved in an auto accident on 5/18/2008. I was driving northbound on interstate 95 headed to new york from virginia. When the accident occured I was In new jersey. Someone hit me in the passenger rear side which caused me to spin out of control and do about 3-4 360 degree turns down the freeway. I finally came to a STOP when the passenger side of my car hit the rear of an S.U.V. At that point the S.U.V stopped for a mere 1-2 seconds and sped off. I was left on the side of the highway by myself. Me and my passenger both sustained what we thought were minor injuries. An officer came wrote a police report (since there were no other vehicles that stopped he wrote it as hit/run). A tow truck then took my car off the turnpike and to the nearest local repair shop. I then had to take a TRAIN to new york from jersey to where my family lives. The next day I went to seek medical treatment for my neck/back/and right shoulder, so did my passenger. I got treatment 3 times a week from a chiropractor and got x-rays. The following week i returned home (virginia) where I found a chiropractor and had my medical files transferred. I have been seeing him since… I have seen a medical doctor, gone to get an MRI, and now have to go see an orthopedist. (The mri found i had a fracture in my shoulder) I went back to finally pick up my car from the shop the framework/ body work/ and paint had been done but they had not done anything mechanically to my car yet they insisted it was READY FOR PICKUP. i was furious so i end up driving my car back home to virginia because i could not waste any more time/money. My car still has check engine light on, abs light on, speedometer doesnt work, suspension was SHOT. the passenger side strut was blown i could tell cause that side of the car had no bouyancy (sp?) to it. I then called my lawyer and he called the insurance company and got them to replace that strut. EITHERWAY the car is still not mechanically sound and back to the state it was before the accident.

MY QUESTIONS ARE….

WHAT STEPS DO I TAKE FROM HERE?
ITS BEEN 3 MONTHS SO FAR AND MY CAR IS STILL NOT RUNNING CORRECT.
I have contacted the insurance company they told me an adjuster would come out to look at my car again and nobody has called me or showed up.

Am i sueing my insurance company?
All my lawyer has done is send out letters of representation to the doctors i have seen that my chiropractor has referred me to…

Auto accident – other driver claims injury?

I was in an accident 8 weeks ago where I didn’t see a delivery truck and pulled out in front of him. The truck barely had any damage, many scratches, and my car was totaled. The driver in the truck got out and said he was fine, even moving the debris out of the road and offering to move my car out of the road.

I found out today that he took 7 weeks off work for back and neck injuries, using his Workman’s comp. The claims agent at my insurance company is a little doubtful of his claim. She finds it odd that he had such major damage when he was in a truck that weighed over 10,000, while I was in a little Chevy Aveo and I had no injury at all and my car got the brunt of the impact. She said she needed to speak to him and see all his doctors notes and that she would keep me informed.

What should I expect? How does this impact my insurance rates going up (I knew they will go up because of the accident being my fault, but does an injury accident make it more expensive?) Also, do I need to worry about being sued by the other driver or should me insurance cover all his costs if they find out the injury is what he says it is ?
I never said the accident wasn’t my fault. I just want to know what to expect.

My question(s) are this: I was at a stop light waiting on the light to turn to a green arrow, I behind this truck and we both went under the light. The next thing I know, my car was spinning and I hit the steering wheel. I went to check on the other people to see if they were ok and they were very rude to me claiming I ran the red light when I didn’t, The police came and it ws thier word against mine and I got the ticket.( no witnesses) This was my first wreck and I have been driving since 1987. I sat there and watched these people climb out of there SUV into the ambulance I later looked up thier names online and sure enough, these people have sued about 5 people in the past 7 years. Both the man and his wife sued the hospital. The wife later sued a clothing store for Prejudism and lost. Her and her husband both sued for another car wreck about 3 years ago and lost it and 2 years ago they sued another insurance company for damages not paid. Now, one year later after the car wreck, I got a letter saying they are suing me.( my name was on the lawsuit). They are claiming debilitating injuries and mental anguish but yet they wait 1 year to the date of the wreck to file suit. I was also hurt in the wreck. I ended up with whiplash and my chest hit the sterring wheel but I never tried to sue anyone. I think that’s the problem with this country. People are sue crazy and we wonder why things are the way they are now. My question is this: Do I need a lawyer when we go to court? I don’t really have the money for a lawyer. I am a mother trying to go back to college and trying to raise a mentally handicap son. I also lost my car as a result of this car wreck and had to drop out of college for 7 months so I lost things too. I was served last Wednesday and I took the suit papers to my insurance company but I have not heard anything back from them. Everyone is telling me the worse that could happen is a judgement( which will give me bad credit) I’m already struggling to get through school and raise my family and now this lawsuit. They cant take much if I dont have anything to give. I have this feeling that these people caused the wreck and are in the business of making wrecks happen but I have no proof because I got the ticket in the wreck and I paid the ticket last year.
