I hate looking like a 45 year old idiot,but there it is.I’ve never bought a car, or had insurance in my name until now.I’ve driven other peoples cars and was added to their insurance, but it was their policy so I never paid attention to the”rules of conduct”before now. I called my insurance company after the 1st accident,on the advice of a few friends.I didn’t think I’d need a lawyer because even though the other driver left the scene before the police had been called, he did come back a few minutes after they got there with proof of insurance so I thought it would be ok.I called a lawyer after my car was towed from the second wreck,which was my daughters fault.The lawyer was positive that I would be back in the drivers seat without a second down payment as soon as both insurance companies worked out who would have to pay for what. I barely noticed the wording when she asked HOW MUCH time I’d missed from work and WHICH chiropractor I was seeing rather than IF I had missed OR WAS I under a doctors care.At her suggestion, I went to a chiropractor and got checked out to make sure There wasn’t anything wrong that I would suffer from after it was to late.I was told my neck hurt because of arthritis and a previous condition that had been aggravated by the wreck.He said he could realign my spine and neck with treatment 3 times a week for a couple of months.The accident didn’t cause it, so I wasn’t going to make him pay for anything he didn’t cause. I guess I made the wrong choice because the lawyer called and said that they wouldn’t be able to take my case because the settlement wouldn’t cover their fees! Shortly after that call, my insurance called to say the other ins.was responsible for payment on the car as it was considered totaled on the 19th.All they are responsible for is salvage value that had been $348 before wrecks,but because of them,it was $325.However, my deductible is $500 which hasn’t been met,so they won’t be paying anything.This morning the other insurance company called and told me that they will send me a check for the estimated value of my car before August, in the amount of $2900.I told him that I needed at least $4558 to pay off the car his client had hit,He said I had been over charged at the start and he needed me to give him the phone number of the finance company so he could let them know of their decision! Wilco finance called me with-in 15 minutes to ask if I was going to get an attorney.to make them pay what I owe,or if I was going to pay them out of pocket.I didn’t know I could refuse to accept that amount until then.If I do,can they just say they made an attempt to pay me and because I refused to accept it,their debt is null and void?Would another lawyer take my case after I declined a lawsuit for pain and suffering?That wasn’t the reason they gave for dropping my case,but if the reason they gave was true,another lawyer won’t do any good!If anyone has any ideas or suggestions,I’d appreciate it.
