Has anyone been involved in car accident arbitration?

I will be the defendant in this case. My insurance company will represent me, however is it fair? The plaintiff is claiming this costly injury, however the accident was only 16days ago.

She told my insurance company she broke her hand, but they found out it was only sprained. Any advice will help. Thanks.

So my gf got into a car accident. she was in a lane merging onto another lane and she said the person behind her sped up, merged into the lane my gf merged into and both cars ended up scraping each other. the lady had a few scratches while my gf’s fender was slightly bent in. she cant really open her car door now. everyone claimed to be fine including my gf’s “friend.” in the end it was my gf who was at fault.
Now a week later my gf’s friend is claiming that she sustained soft tissue damage and now she filed a claim. obviously, the feeling of betrayal is a whole different story but here’s my concern. The friend went hiking right after the accident, and then again twice that week. shes been going to work, and i believe shes been going to the gym as well. she said she went to the doctor and she said she was in a car accident and it was probably whiplash, so the doctor said yes it was that and not hiking, since it doesnt use your lower back(she said her lower back, shoulder and neck hurt).
I think its a fraudulent claim, everyone was fine, the impact was low and i think shes taking advantage of my friend. What do you all think? and besides telling my insurance, which I have, do you have any other advice?

Part of asking this questions is to find out if I could do anything to help my girlfriend. Why would I want to “stay out of it?” if I’m trying to help her from getting screwed over, you oaf. So of course I want to do some investigation to help not only my gf, but her insurance company as well. Whether or not they need it is a different story. As far as the betrayal thing, yeah I agree, probably not worth mentioning that in Yahoo. Minor car accident causing back injury?

I got involved in a minor car accident on the way working in January. The car in front of me made a sudden stop after making a right turn. I hit its rear. Police came over and wrote a report. There was no damage on either car. My insurance company took pictures for evidence. Since that driver worked for a contractor of our company and we saw each other everyday. He said he was fine then we all went to work. Later that day his boss told me he went to hospital to check his back. Later than that he went to physical therapy. I told my insurance company and got his working vehicle information. He didn’t have my insurance information though. Last month I received letter from his lawyer (he didn’t spell my name right), and compensation organization and my insurance company. The compensation organization said they were continuing paying for the cost. My insurance company said the guy’s lawyer claimed the amount above my coverage. I saw him several times at work after the accident but I haven’t seen him for a while. His job is pretty physical. Now I am wondering if my life will get screwed by the minor accident. What should I do?
My salary is pretty low. It has been four months. If my insurance can’t cover the loss, I am not able to pay it off.

I was in a car accident. The other driver did a “squat and stop” scam. (the driver speeds out quickly in front of another driver so he/she wont have enough time to stop and then sit there so the other driver can hit him/her) However, the other driver’s car insurance trying to settle quick. The driver’s car insurance company did their investigation and came to an conclusion that I was at fault.. (yeah right) The accident happen on 4/20/11 and they trying to settle on 4/28/11. (eight days later) When I mentioned that my attorney was handling the case. All of a sudden the company sending me letters claiming it my fault and I have to pay for my own damages. And, that I have so many years to take the claim to court. (hoping that I want) I just fax everything over to my attorney. I am still going through therapy. I do have car insurance. So, why is the driver’s car insurance company trying to settle the claim quick when they was actually at fault? Please, only knowledgeable people reply. Thank you so much
Note: The driver’s girlfriend was told to fake she was injury because she is pregnant. Also, the driver came out the wrong exit of the driveway speeding..

My wife was in a car accident she tore her acl and minscus dr told her she needs to have surgery. The other driver was at fault and admitted this at the scene. The cost of the surgery is 20,000 plus rehab and time off of work. We are turning the claim into my health Ins who will then go after the driver at faults ins. The other drivers limit is 25000 bodily injury. If the limits are exhausted for my wife where do we get our pain and suffering and how much can we do you think we will get. I understand that there’s not a direct formula on what we can get. Also we were told we could go after the driver of the car my wife was in and use there under-insured motorist coverage. Is that coverage able to pay for pain and suffering. Thanks
My wife was the passenger. Her sister was driving and if was her grandfathers car. My wife and I are not named insured on any active policy.

i had a car accident by losing control of my car after driving to close to the curb with gravel. i jerked the wheel to hard at the legal speed of 55, to prevent from going off the road. in the result i lost control of my vehicle and flipped it 3times. i was not under the influences of any substance of any kind. it was a complete accident. i have full coverage insurance. my passenger was air lifted to the hospital for a back injury. my insurance was going to cover all his medical bills, up until he contacted a attorney to further sue my insurance company and myself. in result of all this my passenger will not talk to me anymore and is suing me for the remainder medical fees, future lost wages and future medical fees in which my insurance did not cover. a total of around $90,000 so far without the future costs. my insurance company appointed me an attorney for my case. question is, “will i be responsible to pay this passengers remainder medical bills and future medical bills and lost wages?” this passenger has a criminal history of many wrongs that resulted in jail and prison time. this passenger also does not hold a job long or one at all. the passenger claims to have permanent injures which i don’t believe, because I’ve seen this person drive and walk in public places, such as a bar. i believe this person is able to do things any other person can do. please give me some idea of what might happen in this case. will i have to pay for these things?

so here is the story, sorry for being long.

My younger brother and i had just finished shopping at XYZ Mall. We walked to the parking lot, i was the driver, and backed up out of the parking spot i was in. As i was backing up, i had hit a dark blue Honda car. So i walked out of the car and checked the Honda driver to see if she was ok. Seriously, i didnt even check the damage of the car. The lady walked out of the car and i kept asking CONSTANTLY if she was ok. (she was about 35-40 years old) She said she was fine and proceeded to the damage area of her car. The problem was, my brother and i stood outside looking for the damage for about 5 mins because the damage was not bad at all. The only damage was the scrape of paint of the Honda car. It was the size of a dime about. The lady had smooth her hand all over the side of the car to try to find damage for quite a while. But that was it. The dime size paint scrape was all that was.
Now i am getting a summons and complaints from lady claiming I had injured her AND her passenger. Which I recall there were NO passengers in the car with her. It was just the driver. The second complaint was that she had her car hauled out of the parking lot. Which was NOT true because she drove off just fine.

The whole claim is for $8800 dollars.

We still exchange information because I admit it was my fault of hitting her and it was my first incident that ever happened. I know no matter how big or small accidents can be it should get reported. But the first time i just got so nervous I wasnt thinking right i guess. I just figure she seems like a nice lady and that she said she was fine. so we both let it go. But i told her if she needed to fix the little paint job i can be responsible for it. But she said it was ok. but we still exchange info. anyways and she drove off. NOT HAULED OUT.

I know there is a 2 year limitation to this whole thing. The thing is, The letter said the incident was on July 28, 2006. Which was not true because that time, i was going to a university and took public transportation where ever i went and didnt have a car. I had a car before that when i was going to another university because it was further out to get to. On that point, i just want to prove that there was no way for me to have a car to go anywhere on that date and the 2 year limitation has ended perhaps in 2006-2007.

Because it has been so long i had already lost the information of that lady and have no other proven records to prove my side.

Now i dont know what to do, but my insurance is settling for $8800.

I dont have a problem of my insurance company paying out to them, the only problem is that I hate the fact people lie to get the money.

There was no police report taken, no car hauled. No injuries.

However, on the injury i know they can still claim that they have injury afterwards. but still, i want some justice in my case when i know there was NO PASSENGER, NO CAR HAULED out of the parking lot and passed the 2 year limitation, So now what should i do?

So, I was driving home, when a girl came speeding around the corner in my apartment complex on the wrong side of the road. Long story short, it got ruled 100% her fault. Now I ended up doing 6 months of chiropractic visits and 2 months of physical therapy. I don’t feel different and I am going to have permanant back and neck damage (not severe just not comfortable to be on my feet a long time, sleep, or do strenuous activities, I’m a Chef). That’s not it. My wife was about 37-38 weeks pregnant, and we went to a doctors visit a couple hours after the accident. She wasn’t in the car, but freaked out when she heard the accident and came out of the apartment and saw it was me. The doctor diagnosed her with preeclamsia (high stress during pregnancy) because of the accident and had to induce her that night. The drugs slowed the baby’s heart rate, so they had to give a c-section. They only offered $3k to start and they say my wife doesn’t matter because she wasn’t in the car. suggestions?

First of all both the cars were totaled. I have soft tissue damage, and my back seems to mis-align easily. I had not had any health problems prior at all. I only went to the chiropractor that long because my insurance said to just see if it helps, even though I told them 2 months into it that it hadn’t helped. I had visits 3 times a week. An IME was done, and they said to go to 10 visits of PT and if that didn’t help they may have to rule it as a permanant injury. Though, to get proof, what should I do? It was ruled 100% her fault so it doesn’t really matter with my policy. The medical bills were probably about $5000 total. I most likely can get a letter from my wife’s OB which was also the on-call doctor, saying it was related with the accident. My boyfriend got into a car accident a year ago (may 1st, 07). We have police report stating that it was another guy’s fault ( and it really was). He tried submitting a claim to my boyfriends insurance company, but they declined, and he kinda went away. In exactly a year he has put another claim to the insurance company, and they declined again. My question is – can he sue my boyfriend directly ( not through insurance) if it already has been over the year since the accident?

Ok here is what happend. There was an SUV stopped at a yield due to ongoing traffic which is understanding. I pulled up behind them and fended them because on the corner store an 18 wheeler was turning right to the traffic light and in other words the 18 wheeler would have hit us both. I got down asked if they were ok and called police and made report etc….The EMT asked if they needed assistance and the two ladies in the SUV declined. Fine Now they are suing my insurance & claiming injury. What I dont understand why are they claiming injury?? if they were sooo injured why did they wait till 3pm to go to to the ER when the accident occured at 9 am? The air bags didnt even come out and not even a single scratch on there vehicle. Also the two ladies have seperate attorneys is that possible when suing my insurance or should they have the same when it was the same accident?? Thanks I need some HELP

I was in a car accident about 2 days ago, the other person that was hit is not claiming medical claims for injuries, the accident wasn’t that bad, it was according to the officer a “fender bender”, the impact was mostly on the mid passenger door to the back tire, I’ve been on an accident before and it was even worse that this and didn’t feel anything, I know that everyone is different but she had told me that she works at a chriropractic office so I’m assuming that it has a lot to do with her pursuing the claim.

I just really need an advice on how to go about this, I have car insurance and the damage to her car is taken care off.

PLEASE HELP.
i meant to say, she’s now filing a medical claim. Hopefully your right, that she’s doing this to make sure that she’s okay, where I hope she is.

Car Accident claim…2 accidents 2 months apart..?

I was in an accident in May, in which a driver reversed into my car in a shopping area. He admitted he was @ fault, and i have been to an attorney. I have suffered neck bulges and back pain due to that accident. Unfortunately i was in another accident 3 days ago where a woman in a truck was driving too fast and rear-ended me and pushed me into a parked vehicle. I was sent to the hospital right away and my car was towed. My Attorney has now stated that he wants to cancel my first claim and pursue my second one. Any ideas as to why he would do this? i now have injuries from both accidents and since this is my first time suing anyone i don’t know what to do. Suggestions please
@ guess who, first and foremost i am NOT running and insurance scam! i was injured in both accidents and i was not sitting in a parked car in either accident, so get your fact straight. I am well aware that insurance fraud is a scam, and thats not what im doing here. Its a shame that victims and those injured get treated like criminals by people like you. I was in an accident last April (so just about a year ago now). Basically, a SUV cut accross 2 lanes of traffic and crashed into my car (saturn). I have a witness, an off duty cop saying that it was not my fault and my insurance company found me %100% NOT at fault and waived my deductable and everything.

Just the other day I recieved papers stating that I was going to be sued for $30,000 by the driver of the other car. I believe they are claiming injuries that were caused by my reckless driving?!

No one was brought to hospital from the accident and it wasnt very high impact at all so I really do not think anyone was really injured (he had a passenger). There was obviously damage to both our cars, mine was worse.

I’m pretty angry at this point. I’m wondering if I have a case against the other driver? It makes me so mad that someone would cause an accident then sue the person they hit pretty much blaming them (me) for the accident/injuries.

What does everyone think?
I actually have contacted my insurance company’s lawyer, he was actually on top of this and foresaw a possible suit coming after he had already sent a statement to the guy who hit me attorney saying that he believed I was not at fault in the accident. My lawyer said that they would have 3 years from the day of the accident to file a suit against me and pretty much 1 week after my lawyer told me that , I was served with papers from the sheriff’s office.

So are we saying there pretty much aren’t any grounds for a counter suit?

I had a back injuy and visited the chiropractic doctor for 14 times. I had massages and exercises done for my back .
I was given 4500 for my car. I incurred a medical bill of 1500 for the doctor and incurred a MRI scan for around 2000. I am fine now and I didnt incurred a permanent injury. My Attorney tells me that I dont have a valid case and she is going to make a settlement with my insurance company and the guys insurance company who was at fault. My Insurance policy had a 10000 PIP and I dont know about the guy who hit me. I was unemployed from the time of my accident to this date so I think I am not eligible for compensetation for the wage loss.
Its been 15 days that my doctor have released me and the attorney had requsted a report from my doctor.
So how much claim is my attorney gonna make with the insurance companies? How much money is it likely that I am going to receive from my case?

the other party admitted the fault and i went to emergency room twice for my injury. the claim adjustor of the other party insurance company is trying to settle the case for small amount of money. i don’t want to obtain a lawyer’s help as much as possible.
