I took my car to a BMW certified body shop after an accident. They took two and half months and a lot of headaches to fix my car. Since then I’ve taken my car back three times because of numerous problems, some of them major issues such as alignment and electrical, and they’ve had my car a total of almost 6 months and have charged my insurance over $30,000. My car is still not fixed. Not to mention that I’ve shelled out my $620.00 lease payments while they took their time trying to fix their own errors. My insurance has also doubled (even though I was not at fault in the accident). I am tired of dealing with the owner who I can only get a hold of if I go to the shop. They also charged me for rental cars which they agreed to pay for and they keep telling me that they are “taking care of it.”
I’ve looked far and wide. I’ve used my contacts, the internet and phone calls and cannot find an attorney who takes this sort of case. Please help!!!

California car accident rear ending question?

I was exiting the freeway to the right while slowing to the posted limit of 35MPH. I yielded to the cars on the left (on the main street) to make a safe lane change. As the last car drove over the overpass passing me (at a higher speed than mine) I signaled to change lanes to the left. As I was halfway into the lane the last car (going 40-55MPH, mind you this is pass the posted limit) that passed me, before I changed, suddenly came to a complete stop with more than a car lengths in front of him. I had to veer to the left as much as possible to avoid colliding with his rear bumper, even into the next lane to the left. I ended up hitting his back left bumper with my front right one.

There were no witnesses to the accident. The driver called 911 at least 6 times trying to get an officer to the location. 911 instructed him to just exchange information with me, and that since there were no injuries no police report was necessary.

I found this California vehicle code online, and wonder if it will apply in my favor in this situation.

No website would have news stories that old but the city’s newspapers are in the library on microfiche. Go to or call the city’s library and ask for the reference desk. They will do the research for you for a fee or show you how to do it free.

She was traveling from Missouri or Mississippi to California, her birth name was Kimberly Simmons.

I’m sorry to hear that you lost a friend.

I was unable to find anything with the info you’ve provided, but hopefully you can do better…

1) You need to know the current name, as it will be very difficult to locate her with her birth name (if it has changed).
Also try to find out where the accident occurred. There is a lot of distance between the midwest (or the south) and California. Do you know her home town, and her age?
(I found several accidents regarding a Kimberly Simmons, but I don’t think they have anything to do with your friend – one was a 24 yr old, another 40 yrs old, and both accidents were several years ago.)

The more of this info you know, the better the chances you will find something on the Internet.

2) Here are some tips that have helped me locate such information.
a) If you can find the name of the county or the town, do searches with the name of the town, using
+accident + kimberly+ "name of town"
b) If you cannot find anything that way, look for local newspapers or TV stations:
+"name of town" +newspaper
+"name of town" +media
+"name of town" +TV stations
Then when you find the paper or the TV station, do searches on their site (especially in "archives") to see if you can find articles about your friend.
c) Look for obituaries – these would be in your friend’s hometown paper, but they will not appear until about 3-7 days after the death. These may actually show the birth name, so you may have to keep searching for a week or more.

Yes, you have to report the accident to the DMV if the damages are over $750 or if there’s any bodily injury. If the insurance company reports this before you do, the DMV will suspend your license for not reporting it.

No. That’s why they are called "accidents". (They’re really called collisions by police.)

You got hit by a car, so you think bikes are more likely to have an accident. OK, let’s skip that logic. More bikes may be involved in accidents in that area on that day under those conditions. Shall we expect a rise motorcycle accidents/deaths?

As more people seem to be more attracted in buying motorcycles to get better gas mileage with gas prices being so high, can we expect alot more inexperienced riders on the road resulting in many more accidents than we normally would see and maybe an increase in insurances?

Or can we expect alot more motorcycles on the road, period, resulting in less larger cars and trucks on the road which may actually make the roads more safe for motorcyclists?

Look at the number of people on this forum inquiring which sport bike is good for a beginner. The number of incredibly fast, high speed motorcycles in the hands of complete novices will continue to lead to an increase in accidents and fatalities. The other aspect that will increase accidents/deaths is the high number of unskilled, uncaring, angry, distracted motorists. For example I have never witnessed so many drivers blatantly running red lights in the last few years as I have during the previous 30 or so years of driving.
If I was in charge, it would be a lot harder to get a driver’s license. The fees would be about 4 figures. That money would go toward real driver’s education. A new driver would be required to attend an advanced driving school such as the one offered by the Bob Bondurant driving school.
Also I would pull a lot more licenses and impound the offender’s vehicle. Blatant disregard for safe driving would not be tolerated. The laws would have real teeth to make it very clear the consequences for bad unsafe driving/riding.
Same would go for driving and drinking. Drunk driving also would not be tolerated if I was in charge. So many lives have been prematurely ended due to some fool have a few too many and getting behind the wheel.

Want to buy life insurance but will it cover motorcycle accidents?

My husband has a motorcycle. Just bought it. I would like to take out a life insurance policy so I can afford our home or his funeral if someone texting on their cell phone kills him.

Do most life insurance policies include motorcycle exclusions or increase premium if you own motorcycle. I do NOT want to end up with an invalid policy.

Easier to ask the insurance company rather than us. Different companies may have different policies re: motorcycles, although I wasn’t aware it was difficult to get life insurance for motorcycle riders.
