I was in a car wreck two days ago, and am now out of for for about two weeks, the guy rear ended my car and every time I call his insurance company, which is Gieco, I always end up just getting an answering machine. In turn of this guy hitting me, I hit the car in front of me, and my car is totaled! I didn’t go to the hospital in an ambulance, but walked into the ER an hour or so after this had happened.
Anyway, I’m wondering that since I’m only 18 should I get a lawyer to help me with getting everything handled? This is the first accident that I’ve been in when I’ve been the driver and in the car by myself….
SOMEONE PLEASE HELP AS TO WHAT I NEED TO DO!!!

Someone, I just really need some help, I am at a complete loss! The car title and tag are in my name but my insurance in under my dad, but I pay it. If that matters.
I know the insurance ppl should take care of it, but they haven’t even told me anything. And I need to be able to get around and actually go get what I need, but I’m out of a car…..

contact your insurance company and they will give you guidance. some insurance will cover you up front then go after the other party’s insurance company so that you dont have to.

You need to get hold of YOUR insurance agent. They’re going to have to be involved sooner or later and they will take care of working with the other insurance company. In the event it goes to court they will provide a lawyer so you won’t be out of pocket. Talk to your agent. That’s what you pay premiums for. Use it.

Nope, just file the claim with YOUR insurance company, and let them handle it.
But you have a problem. If the title of the car is in YOUR name, but the policy is in someone ELSE’S name, that’s insurance fraud. And the insurance company doesn’t have to pay out.

Okay, first and foremost….calm down, I can almost feel your panic on the other end of the computer.
Call Geico’s 24 hour claims reporting hotline. This is a number answered by a live person. The trick to getting things done is that sometimes you have to bother people, machines can’t be bothered, live people can, so anytime you can talk to a live person you take it! Find out your adjustors name/number. If the claim hasn’t been reported, report it as best you can. If your issue is that you have all the adjusters information, but you can never actually TALK to the adjuster, thats a different issue. In that case, you need to “0″ out, and tell the receptionist that you need to talk to that persons supervisor. If that voice mail comes on, talk to any supervisor. Keep dialing “0″ and complaining until the receptionist gets someone on the phone for you. Trust me, the last thing they want to do is be bothered with your phone calls so if at all possible they will find someone in that office to talk to you. Once you get a supervisor explain the situation to that person. If you have collision coverage then your insurance will take care of your vehicle for now and then send the bill for repairs to Geico. If not then talking to someone at Geico is VERY important because if your vehicle was totaled and its sitting in a towyard its just racking up fees and Geico will want to look at it and settle the total loss to your vehicle as soon as possible. You will also want to know if there are any potential “limits” issues. On every liability policy (the insurance that people buy to cover damages to someone else’s vehicle) there is a certain dollar amount of coverage for property damage. You want to talk to Geico to make sure that this policy will have enough money to cover the damages to your car and for your rental vehicle. If possible have Geico direct bill the rental since they will owe you for it. As you hold the title on the car the total loss payments will be made to you.

As per the injury, make sure to keep your bills and proof of how much you make at work and proof that you missed 2 weeks. As well the doctors orders that you take the time off. From what I can glean it sounds like you have a soft tissue injury. A case of whiplash. As you are young and healthy the healing process should be pretty straightforward. You may want to wait and talk to the insurance carrier and see what type of offer they will make you to settle your claim when the time is right and you feel better. Make sure to follow doctors orders and do what is best for your body before considering a settlement. When you feel ready then you can talk to the adjustor about settling the claim. In your case as a healthy young person in another 2 weeks you’ll probably be feeling TONS better. You can get a lawyer anytime in the claims process, so you may want to listen to what the offer is first before getting an attorney and giving him 1/3 of any settlement.
