A lot will simply depend upon how much the person who hit you carried per accident/per person on their insurance policy.
You COULD sue them for more, I suppose, but I’d seriously think about what you will be taking from them if you do. Get what is fair, but please don’t sue for more than you think is fair, particularly if there are children, etc. in their family.
There’s always this thought too……next time, it could be you who causes the accident. I was in an accident 5 months ago, and for the first time in my life, I was at fault. 100% and I admited from the beginning. Thank GOD the lady I hit was not injured badly, but she was injured. I was injured quite badly, hospitalized for a week, out of work for 2 months, required home nursing care, months of physical therapy, etc.
Of course, she got a settlement from my insurance for her injuries and time off work, etc. but I am so very grateful that she was kind, understanding, and didn’t try to take the roof from over my head.
I hope you and your girlfriend stay well, and that you do get a fair settlement. I know how much it sucks to be the party who was not at fault too!

The most you can get is what ever the limit pay off is on the others persons insurance. which usually is 50,000 per occurrence. So best case scenario you will each get 25,000 but that depends on the injuries.

You have hired a lawyer.
You will be paying him 1/3 (33%) to 1/2 (50%) Plus expenses from any settlement you get.
Since you will be paying your lawyer such a very large part of any settlement – ask him.
He’s the one who knows your case and that’s what you are paying him so much money for.

MSAD is correct. Ask your attorney. Your compensation depends on the tort laws of the state this accident occurred. You may not even be tort eligible.
