I have a friend who was in a car wreck that was the other person’s fault. He was treated for whiplash and received physical therapy for a month. He hired a lawyer to help him settle and his lawyer told him today he would get $10,000. My friend is upset because after medical bills are paid back to insurance and after paying the lawyer (who gets 1/3), he will only get back around $1200. He feels he should get more than this but I think this is not unreasonable. Can anyone give some advice as to whether he should fight to get more or if this is a standard amount that is expected and he should settle for it.
His medical insurance did pay for it. However, they want reimbursed for what they paid-so that is going to take most of the settlement amount-plus what his lawyer is taking. He feels that after paying back his insurance company and lawyer, he should end up with more than $1200. He wants to try to get $15,000 instead of $10,000 because of this.
As far as I know, he does not have any permanent damage. He is wanting more for pain and suffering that he had during that time.
