Turns out the girl that hit them didn’t have valid insureance. Her tag was expired and she got a ticket for that plus for careless driving (for causing the wreck). Netier insurance is wanting to pay to get the car fixed,I dont care about the girls car she is causing us so much problems, I know youre not supposed to
wish ill to anyone, but she wouldn’t get off her damn cell phone,
even when the cop was talking to her, tried to pass my sister at a yeild sign then the merge area.Anyway, we have got to get our car fixed. My sister only had a learners permit but she was driving with someone well over 21. But now our insurance is saying she was excluded on the policy since when wegot the policy she was only around 13 she couldn’t be included. I was calling lawyers and they were all gun ho to get it started. I just found out about 3 hours ago about the girls insurance and I called some of the lawyers back and now I’m getting the run around. just need some advice. Where do we start?

My advice would be to contact your agent again and if they still aren’t willing to help with getting the car fixed then tell them you are planning to contact your state insurance office, they are the people who take care of making sure that insurance companies are doing what they are suppose to. You may even try the state attorney generals office. The only way you will get anything from the other driver is to sue her personally, but my guess is that there is nothing to get kind of like squeezing blood from a turnip. That is why when you called the attorneys back telling them she had no insurance they backed off because they knew there was nothing to get and it will end up costing you in the long run.
I always thought that even though you someone else hits you, if your car is insured and they don’t have insurance that is was covered. I would also request a copy of my policy, because I don’t understand why her age at the time of the policy being written would have anything to do with her not being covered. Wasn’t she covered then? How long ago was the policy change as to how old she is now? Just don’t let them get away with not paying.

While I cannot say what all insurance companies will do, USAA will attach the other persons wages until the damage is paid for. They paid to fix my car, but got their money back from the uninsured. How they did this, I do not know.

Here in the U.S. the vehicle is insured, NOT the driver. Therefore, unless the driver was NAMED as an excluded driver then your collision coverage is valid on your car. I suggest you call your insurance company, this time ask for a manager, and ask them to explain their reason for denial — ask them to explain it until you UNDERSTAND it. There could possibly be a valid reason why the claim was denied.
